Terms of Service
These terms govern purchases from Quicky Solutions LLC and use of the products we provide.
Effective August 14, 2026
1. Agreement
By purchasing, accessing or using a Quicky Solutions product, you agree to these Terms of Service (“Terms”). If you act for a business, you represent that you can bind that business. If you do not agree, do not purchase or use the product.
2. Products and public pricing
- Yacht OS Founding Operate: $995 USD activation, then $495 USD per month. Yacht OS is yacht operations software for vessels, quotes, bookings, contracts, teams and guest workflows. Managed Growth is $995 USD per month fixed. A performance billing alternative is $695 USD plus 5% of qualifying completed campaign-attributed revenue, capped at $1,495 USD per month. The applicable written offer defines qualifying revenue.
- Clinic OS - $2,500 USD setup, then $1,900 USD per month. The one-time setup fee covers the agreed onboarding and implementation scope. The recurring subscription includes software access, hosting, updates and support for the agreed clinic operation.
- Business Website - $1,500 USD one time. A custom business-website package delivered digitally. Scope, required customer materials and delivery timing are confirmed before work starts.
- Custom Builds - starting at $2,500 USD. Purpose-built software for a defined business workflow. Final scope, milestones, ownership terms and total price are confirmed in a written proposal or statement of work before development begins.
The current public offer is also shown on our Pricing page. A written order, proposal or statement of work may add product-specific scope or terms. If it directly conflicts with these Terms, the signed written agreement controls for that purchase.
3. Orders, payment and taxes
PayPro Global acts as merchant of record for purchases completed through its checkout. PayPro Global processes payment, calculates applicable transaction taxes and provides receipts and customer-portal functions. Your checkout may also be governed by PayPro Global's customer terms. You authorize the stated charge when you place an order. Except where a checkout states otherwise, fees are charged in U.S. dollars.
4. Subscriptions and cancellation
Clinic OS and monthly Yacht OS plans renew monthly until canceled, subject to any minimum term stated in a signed written offer. You may cancel through the customer portal linked from your receipt when available, or by emailing info@quickyy.life. Cancellation stops the next eligible renewal and takes effect at the end of the current paid period or written minimum term. Access ends when the paid period ends unless law or a written agreement requires otherwise.
5. Delivery and customer responsibilities
We will provide onboarding or delivery instructions after purchase. You are responsible for timely, accurate content, access, approvals and other materials reasonably needed to configure or deliver the product. A delay in those materials can move the delivery date. You are responsible for your users, account security, lawful instructions, and the accuracy and legality of data or content you provide.
6. Refund policy
If we charge the wrong amount, charge after a timely cancellation, or cannot provide the purchased product, contact us and we will correct or refund the affected charge. For the Business Website or a Custom Build, a full refund is available before work begins; after work begins, any refund reflects the undelivered portion of the agreed scope. A Yacht OS activation payment is refundable before implementation begins; after implementation begins, any refund reflects the undelivered portion of the agreed activation scope, unless the signed offer states otherwise. For Clinic OS, you may request a refund of an initial payment within 14 days of purchase if onboarding has not begun and the software has not been materially used. Renewal periods and partially used subscription periods are otherwise non-refundable, except where required by law. 7. License, ownership and customer data
During an active Clinic OS or Yacht OS subscription, we grant the customer a limited, non-exclusive, non-transferable right to use the software for its internal business operations. Quicky Solutions and its licensors retain ownership of the software, platform, reusable components and pre-existing materials. The customer retains ownership of its data. Yacht OS retains its reusable platform intellectual property while each operator retains its records and tenant-specific content.
After full payment for a Business Website or Custom Build, the customer owns the final customer-specific content and deliverables identified in the order. Quicky Solutions retains its pre-existing tools, general know-how and reusable components, while granting the customer the rights needed to use them as included in the delivered website.
8. Acceptable use
You may not use a product to:
- Break law, infringe rights or facilitate fraud or deception.
- Upload malware or disrupt, probe or bypass product security.
- Access another person's account or data without authorization.
- Resell or sublicense the product unless we agree in writing.
Clinic customers may process sensitive or regulated information only in an environment and under agreements expressly approved for that use. A signed business associate agreement is required before using Clinic OS for protected health information.
9. Support, updates and availability
Support is available at info@quickyy.life. We may update products to improve security, reliability or function. We work to keep hosted software available, but maintenance, provider failures and events outside reasonable control can interrupt service. Any specific service level must be stated in a signed written agreement.
10. Confidentiality
Each party will use reasonable care to protect non-public business, technical and customer information received from the other and will use it only to perform the relationship. This does not cover information that is public through no breach, independently developed, lawfully received from another source or required to be disclosed by law.
11. Warranty disclaimer
We will provide the products with reasonable care and skill. Except for express promises in a signed written agreement and rights that cannot be excluded by law, products are provided “as is” and “as available.” We do not promise that every product will be uninterrupted, error-free or fit for a purpose you have not disclosed to us.
12. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue, goodwill or data. Quicky Solutions' total liability arising from a product will not exceed the amount paid for that product in the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.
13. Suspension and termination
We may suspend access when reasonably necessary to prevent harm, address a security risk, respond to nonpayment or investigate a material breach. We may terminate for an uncured material breach after reasonable notice, or immediately when required by law or necessary to prevent serious harm. Terms that by nature should continue-such as ownership, confidentiality, disclaimers and liability limits-survive termination.
14. Governing law
These Terms are governed by Florida law, without regard to conflict-of-law rules. State and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction, unless applicable law requires another forum.
15. Changes and contact
We may update these Terms prospectively by posting a revised version and changing the effective date. Material changes to an active paid product will be communicated when appropriate.
